1. Purpose
These general terms and conditions of sale define the rights and obligations of the parties within the framework of remote booking of services offered by How'Events SRL at Domaine de la Forgerie, located in Warneton (Belgium). These services mainly concern the rental of a gîte, as well as, where applicable, additional services such as the provision of a reception room.
These terms and conditions govern all the steps necessary for booking and managing the reservation between the parties. The customer acknowledges having read these general terms and conditions of sale and accepts them without reservation.
2. Reservation
The customer chooses the services presented on the booking platform. He acknowledges having read the nature, characteristics and booking procedures for the services offered, as well as the information necessary to complete his booking.
The client is solely responsible for their choice of services and their suitability for their needs. The reservation is deemed accepted by the client upon completion of the booking process.
3. Booking Process
Reservations are made via the online booking platform or by any other means offered by the establishment. Prior to making any reservation, the customer agrees to complete the requested information and guarantee its accuracy.
The booking process includes selecting services, accepting these terms and conditions, and making payment according to the applicable terms. The booking becomes final upon confirmation of these elements.
4. Booking confirmation
The customer's booking is confirmed by email. This document summarizes the services booked, prices, applicable conditions, and information useful for the smooth running of the stay or event.
The customer is required to verify the information mentioned in the confirmation and to report any errors as soon as possible.
5. Cancellation or modification by the customer
Cancellation conditions vary depending on the services booked.
When booking the cottage only, the cancellation conditions are those of the rate selected at the time of booking.
For bookings that include a reception room, all cancellations must be notified in writing. Fees apply depending on the cancellation notice period. In the event of cancellation more than eighteen months before the scheduled date, administrative fees may be charged. Between eighteen and six months before the event, the deposit paid is non-refundable. Less than six months before the scheduled date, the full amount of the reservation is due.
Deposits paid for event services are retained as compensation. Any change of date is considered a cancellation, unless otherwise agreed in writing by the venue. If the venue is re-let for the same date, a partial refund may be considered, less any expenses incurred.
6. Consumption of the service
The client agrees to use the rented premises in accordance with their intended purpose and to respect the facilities provided. They are required to comply with the establishment's internal regulations and any instructions given.
For events including the reception hall, the client agrees to respect the agreed times, noise standards, as well as safety and good neighborliness rules.
The client agrees not to exceed the maximum permitted capacity of the premises.
Any behavior contrary to good morals, public order or the rules of operation of the establishment may result in the interruption of the service, without refund.
7. Responsibility
The client is responsible for all damages caused by themselves or by their guests during the rental period. They agree to use the premises responsibly.
The establishment cannot be held responsible for loss, theft or damage to property belonging to the client or their guests, nor for accidents occurring during the stay or event.
The client agrees to be covered by a valid civil liability insurance policy.
8. Complaints
Any complaint relating to the non-performance or poor performance of services must be addressed in writing to the establishment within fourteen days of the end of the stay or event.
9. Price
The prices of the services are indicated before and during the booking process. They are expressed in euros, inclusive of all taxes, and correspond to the services described.
Certain additional services, including room rental, optional extras, staff, or specific services, may incur a surcharge. Tourist tax is payable on site.
Any legal or regulatory changes may be reflected in the prices.
10. Payment
Payment terms vary depending on the services booked.
For the cottage only, the payment terms are those indicated at the time of booking and may include partial or full payment depending on the chosen rate.
For any reservation including a reception hall, a deposit of fifty percent of the total amount is required at the time of booking. This deposit is binding on both parties. The balance must be paid according to the terms specified in the booking confirmation or contract.
In case of failure to meet deadlines, the establishment reserves the right to cancel the reservation, with sums paid remaining non-refundable.
The balance must be paid no later than before the start of the service, according to the conditions specified in the contract or booking confirmation.
11. Caution
A deposit is required when booking a reception room.
This deposit is requested in the form of a bank imprint, at the latest upon entry to the premises.
Its purpose is to cover, in particular:
- damage caused to installations or equipment
- failure to comply with the terms of use
- additional cleaning fees
- exceeding the permitted hours or any other improper use
The deposit is released within a maximum period of fifteen days after the end of the service, subject to the absence of damage or deficiencies being noted.
12. Respect for privacy
The personal data collected during the booking process is necessary for managing the booking. It is processed in accordance with applicable regulations.
The customer has a right to access, rectify and delete their personal data, which they can exercise by contacting the establishment at the following address: contact@domainedelaforgerie.com.
13. Cleaning
The client agrees to return the premises in a reasonably clean condition.
In this capacity, he is specifically asked to:
- to empty the bins
- to put the furniture back in place
- to clean and put away the used dishes
- For the cottage, remove the bed linens and gather them in the designated area.
When the reception hall is also rented, these obligations also apply to the spaces concerned.
In the event of failure to comply with these instructions or if cleaning is deemed insufficient, additional charges may be applied.
14. Convention on Evidence
The validation of the reservation and the payment constitute an electronic signature having the same value as a handwritten signature between the parties.
The computer records kept by the reservation systems are considered as proof of the exchanges, reservations and payments made.
15. Force majeure
Force majeure is understood to mean any unforeseeable, irresistible event beyond the control of the parties that prevents the normal performance of the contract.
It suspends the obligations of the parties without compensation. A postponement may be offered depending on the availability of the establishment.
The following are considered cases of force majeure:
- natural disasters that make the site inaccessible or dangerous (floods, storms, fires)
- exceptional weather conditions preventing access to the estate
- administrative or governmental decisions prohibiting the event or the operation of the site
- pandemics or health situations leading to legal restrictions
- prolonged power outages or failures of essential networks beyond the control of the establishment
This list is not exhaustive.
Adverse weather conditions do not constitute a case of force majeure, unless they render the site inaccessible or dangerous.
Exceptional circumstances
In the event of serious exceptional circumstances affecting the client, such as the death of the client, their spouse or a close relative (parents, children), the establishment may, as a commercial gesture and without being legally obligated to do so, offer to postpone the reservation subject to availability.
No refunds will be automatic, but each situation will be examined on a case-by-case basis.
16. Dispute Resolution
These general terms and conditions of sale are governed by Belgian law.
In the event of a dispute, the competent courts will be those of the registered office of How'Events SRL.
17. Completeness
These general terms and conditions of sale, the specific conditions applicable to the reservation and, where applicable, the contract signed between the parties, constitute the entire agreement.
In case of conflict, the provisions contained in the contract or booking confirmation shall prevail. The establishment reserves the right to modify these terms and conditions at any time; the applicable terms and conditions are those in effect on the date of booking.
